Terms and Conditions - Jersey Shore Photography

This agreement is made between you (as listed above) hereinafter “You”, and Jersey Shore Photography hereinafter “Us/We”. “Session” is any of the photo shoots you have purchased and scheduled for a specific date and time during which we agree to take digital photographs (“Images”) of you and/or your family members.

A non-refundable retainer of 25% is required to secure your booking. The remaining balance is due prior to the start of the session.
Payment can be made via cash, check, or electronic transfer. Details will be provided upon booking.
The booking is not official until the contract is signed and the retainer is received.

Cancellations must be made at least 48 hours prior to the session to avoid a cancellation fee of 50% of the total session cost. Cancellations made 48 hours or less before your Session start time are non-refundable.
You may reschedule your Session with written notice provided at least 48 hours in advance of your Session. Your payment may be applied towards another Session for up to one year. Subsequent rescheduling requests and/or rescheduling less than 48 hours prior to your Session will incur a $100 Rescheduling Fee.
Please arrive punctually to make the most of your Session. We will have to reschedule your Session if you arrive more than 20 minutes late. $100 Rescheduling Fee applies.
We maintain the right to reschedule your Session due to inclement weather or unforeseen circumstances. RAIN POLICY: Should the weather forecast predict a 40% chance of precipitation (or higher) 8 hours prior to your Session, we will contact you to reschedule for an alternate date free of charge.

Sessions are limited to immediate family members. Grandparents and other extended family members must be arranged beforehand, and additional fees of $20/person will apply.
Other cameras or video recorders are not allowed at the Session.
Jersey Shore Photography will provide guidance on poses and locations, but client cooperation is essential for optimal results.
Sessions will start and end at the agreed times. If the client is late, the session will still end at the scheduled time.

We use our artistic discretion in the culling and editing process. You may view samples of our editing style on our website. Additional editing requests are billed separately.
Editing the images yourself, or by a third party requires our consent.
We DO NOT release RAW unedited images.

Edited high-resolution images will be delivered within 2-3 weeks after the session via an online gallery. We strongly encourage you to back-up all downloaded images on more than one device as redundancy in case of hardware failure.
Clients will receive the minimum number of edited images listed in their contract.

Jersey Shore Photography retains all copyrights to the images. Clients are granted a non-exclusive license to use the images for personal use.
Images may not be used for commercial purposes without written consent from Jersey Shore Photography.
Jersey Shore Photography reserves the right to use images for promotional purposes, including but not limited to, social media, website, and marketing materials. If you prefer your images not be used, please notify us in writing prior to the session.

In the unlikely event of a camera or equipment failure, or any other unforeseen incident that prevents Jersey Shore Photography from completing the session or delivering the images, liability is limited to the refund of all payments received.
You release Jersey Shore Photography, Molly Lawlor, and its employees & contractors from all claims, damages, and liabilities that may result from accidents or incidents that occur during the Session. You release and discharge us from any and all claims and demands ensuing from or in connection with the use of the images, including any and all claims for libel and invasion of privacy. This authorization and release shall inure to the benefit of the legal representatives, licensees and assignees of Jersey Shore Photography.

In accordance with United States Copyright Law, we retain our own, sole, and exclusive copyright to all images, including but not limited to our use of them for marketing purposes. By booking a session, you agree to grant Jersey Shore Photography permission to use the images of yourself and any others participating in the session, including minors, for promotional purposes.
If you do not wish to have your images used, you must inform us in writing prior to the session.
Your use of the images is limited to personal, non-commercial purposes, and you may not sell or assign the images to a third party.

Clients are responsible for their own attire, props, and punctuality.
It is the client’s responsibility to inform Jersey Shore Photography of any specific shots or poses they desire at least 24 hours prior to the session.

These terms and conditions are subject to change at any time. Clients will be notified of any changes prior to their session.
By booking a session with Jersey Shore Photography, you acknowledge that you have read, understood, and agree to these terms and conditions.

By completing your purchase, you agree that you have read, understood, and agree to these Terms & Conditions in their entirety.
